About Conservatorships

A conservatorship is a court order that appoints a person as the conservator for the care of the conservatee. The conservator is generally a family member, close friend, or a private professional fiduciary. The conservatee is the person who requires facilitation or maintenance.

There are two types of conservatorships:

  1. Conservator of the person: A conservator of the person assists the conservatee’s daily needs, including personal care, healthcare, meals, transportation, housekeeping, clothing, and recreation
  2. Conservator of the estate: A conservator of the estate manages and maintains the conservatee’s finances, including contracting, protecting conservatee’s assets, buying/selling property, collecting income, paying bills, and investing

When a conservatorship is secured, the conservator must objectively act in the best interests of the conservatee and take into account the conservatee’s opinions and desires. Courts will always consider the conservatee’s wishes and then determine whether the conservator’s contrary demand is in the best interests of the conservatee.
